Gold and Silver Are Now Legal Tender in Texas

Gold and silver became legal tender in Texas this week. A provision of House Bill 1056, the sound-money law Governor Greg Abbott signed in 2025, took effect on September 1, and with it the state now recognizes the two metals as a lawful form of payment.

The recognition is real, but the law is careful about its limits. Gold and silver qualify as legal tender when they are marked with their weight and purity and are not passed off as government-issued currency. And no Texan can be forced to use them. The statute says that no person may be required to offer or accept gold or silver as payment for a debt or for any other purpose. What it creates is an option, exercised by agreement, not a mandate.

The machinery that would make that option practical for everyday spending is still being built. The same law directs the state comptroller to stand up an electronic payment system, backed by bullion held in the Texas Bullion Depository, that would let Texans move gold and silver the way they move dollars. That system is authorized to launch in the spring of 2027. Until then, the change is foundational rather than immediate: the legal recognition is in place, and the plumbing is coming.

The direction is what matters. For years the Texas Nationalist Movement has argued that a Texas prepared to govern itself has to control the foundations of its own economy, money among them, rather than leave them entirely to a Federal Reserve it does not answer to. A state depository full of gold, and a law that makes that gold spendable, is the kind of infrastructure that argument depends on. Every Texan who can settle a debt in metal is a Texan a little less bound to Washington’s dollar.

Texas is not the first state to recognize sound money, though its backers say no state has gone as far. The recognition is now law, the depository is built, and the electronic payment system has a launch date. Piece by piece, Texas is assembling the machinery of a state that can run its own money.
