Copyright and DMCA notices
texianpartisan.com is hosted and managed by Texas Nationalist Enterprises, Inc., which receives copyright notices for it. We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. section 512.
Reporting claimed infringement
If you believe material on texianpartisan.com infringes a copyright you own or control, send a written notice to our designated agent. The notice must include:
- Your physical or electronic signature, as the copyright owner or a person authorized to act for the owner.
- Identification of the copyrighted work you say is infringed. If one notice covers several works on the site, a representative list of them is enough.
- Identification of the material you say infringes, with enough detail for us to find it. The web address of the page is best.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.
When we receive a complete notice, we promptly remove the material or disable access to it, and we tell the person who posted it.
Designated agent
Copyright Agent
Texas Nationalist Enterprises, Inc.
P.O. Box 403
Nederland, Texas 77627
Phone: 800-662-1836
Email: [email protected]
This address handles copyright notices only. Our agent is listed in the U.S. Copyright Office’s DMCA Designated Agent Directory under registration number DMCA-1084313.
Counter-notice
If material you posted was removed and you believe it was removed by mistake or misidentification, you may send a counter-notice to the designated agent. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled by mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Texas Nationalist Enterprises, Inc. may be found), and that you will accept service of process from the person who sent the original notice or that person’s agent.
We send a copy of your counter-notice to the person who sent the original notice. Unless that person tells us within 10 business days that they have filed a court action to keep the material down, we restore it 10 to 14 business days after we received your counter-notice.
Repeat infringers
We close the accounts of users who repeatedly infringe copyrights. An account that is the subject of three valid notices within 12 months is closed, and we may close an account sooner for deliberate infringement.
False claims
Under 17 U.S.C. section 512(f), a person who knowingly misrepresents that material infringes, or that it was removed by mistake, can be liable for damages, including costs and attorney’s fees. If you are not sure whether material infringes your copyright, consider talking to a lawyer before you send a notice.
