He puts it in context. The ruling came down just after the Civil War, written by Chief Justice Salmon P. Chase, and the Court that issued it is the same institution that once blessed slave-catching and segregation before those decisions were overturned. Texas v. White, Kacy argues, settles far less than its boosters claim.
