Tony McDonald describes the Texas Ethics Commission as two agencies in one. There’s the office where candidates and activists file campaign finance paperwork, and there’s an enforcement arm that hears complaints behind closed doors in the Capitol basement. Any politically engaged Texan who spends money on flyers or a yard sign can fall under its reporting rules, he says, and the cases start with a political opponent combing through someone’s forms.

McDonald says the accused get no appointed lawyer and face a hearing where staying silent counts against them, with a possible criminal referral in the background. He recounts the complaint in which a state representative accused Abraham George of a felony for telling the lawmaker he expected a vote for the Republican nominee for speaker.

Voters approved the commission to recommend legislative pay, McDonald says, and lawmakers then handed it enforcement power over the people who run against them. Its members face no election and can’t be removed. His fix is legislation stripping the commission of jurisdiction over private citizens.
