Varney put Judge Napolitano’s view to Daniel Miller: that leaving the union would take a constitutional amendment, with supermajorities in Congress and ratification by the states. Miller said that with all respect to the judge, the claim is simply wrong.
The Constitution says nothing about a state leaving the union, Miller told Varney. Under the Tenth Amendment, powers it doesn’t address are reserved to the states and the people. That sends the question back to Texas law. Miller pointed to Article I, Section 2 of the Texas Constitution, which he said places the right to change or abolish the form of government solely with the people of Texas.
The exchange came down to where the authority to decide sits. Varney treated it as a matter for the federal amendment process. Miller put the decision with Texans alone.
